The company, us, we, MJM refers to Mad Jam Music.
Purchaser, you, customer, consumer refers to customer
Goods, products items, refers to items posted for sale and sold by Mad Jam Music
Ownership/Title of Goods
Ownership/Legal title of goods shall pass to the customer only when payment in full has been received by Mad Jam Music.
Price
Unless stipulated prices on the Mad Jam website publication are shown exclusive of VAT. However, this is subject to change without prior notice and it is for the customer to read the footnotes of any published material where any such changes will be stipulated. Mad Jam Music also reserves the right to change prices when it becomes necessary as dictated by external market forces i.e. Inflation, Increased carriage costs etc.
Goods & Product Specification
The goods/products sold by Mad Jam Music are not manufactured by Mad Jam Music. Product specifications on this site are "as is" illustrated. Manufacturers are entitled to and will without notice alter product specification from time to time. As Mad Jam Music cannot be held responsible for such alterations, errors or omissions, it advisable that you read the product specifications thoroughly to make sure that the product purchased is the correct product for your specific requirements. When these changes occur Mad Jam Music will make every effort change the product specification on the website but will be under no obligation to notify the customer of any such change before the goods are dispatched. Where a specific product has been ordered and is no longer available Mad Jam Music will notify the customer and if in agreement with the customer, endeavour to send a replacement of equal or better quality. The company also reserves the right to withdraw goods from sale without prior notice. Goods are subject to availability. The listing of a product does not in any way guarantee the availability of that product. Please note in cases where the correct goods have been dispatched by us we cannot exchange, refund or compensate for purchases made in error or because a product does not provide the specific features and/or functions required. Images and descriptions displayed at www.madjam.co.uk and www.madjam.com website are supplied by the product manufacturers and as such Mad Jam Music cannot be held responsible for any misrepresentation of products.
Payment Terms
Where applicable all goods must be paid for in full before dispatch either with legal tender, cheque or by an authorised credit/debit card. Where there is any dispute as to the authenticity the of payment means, Mad Jam Music reserves the right to retain the goods and the title of the goods/products and not to release the goods/products until full and proper payment has been obtained from the customer by Mad Jam Music. When cheques are used to pay for goods it is understood that funds from the cheque must be cleared in the Mad Jam bank account before goods are dispatched to the customer.
Lay-Away (Paying by Instalments)
Lay-Away facilities will be given solely at the discretion of Mad Jam Music. When lay-away facilities are given it is to be understood that any monies paid to Mad Jam Music will be non-refundable as they will be used to secure the item for the customer and or to protect the resources of the company. Lay-Away customers unless given expressed written permission from Mad Jam Music will have ninety (90) days maximum from the time of the first instalment to make full and complete payment for the reserved goods. If no extension of the ninety days has been granted any monies paid to Mad Jam Music will be forfeited by the customer and the goods again made available for sale to the general public. The same is applicable if the extension date has expired and full payment has not been received. Again in this instance any monies paid to Mad Jam Music will be forfeited by the customer.
Credit Accounts
Where credit is given it is understood that invoices are to be paid thirty (30) days from invoice date. Invoices are line item detail and carry an ‘Invoice Total’. Balances are to be paid in full and without discount within the specified time unless by prior agreement given in writing from Mad Jam Music other arrangements have been made. Mad Jam Music reserves the right to levy a collection charge on overdue accounts as stipulated on any issued invoice. The company reserves the right to suspend or terminate any credit facilities given in the event of non-payment. At the discretion of the company Mad Jam Music may offer a discount if payment is received strictly within the specified previously agreed time limit and there are no other invoices outstanding on the account.
Dispatch
Goods available from stock will be despatch for non account customers as soon as cleared funds confirmation is received and for account customers as soon as order is complete. For account customers: - If an order is awaiting an item from one or more of our suppliers the part of the order that is held in stock will be dispatched to you and the invoice for goods less the outstanding item issued. When the outstanding item(s) is/are in stock it/they will be sent on with the invoice for the outstanding item(s).
Liability
Mad Jam Music will endeavour to ensure that information in any published media is correct. MJM shall be under no liability in respect of a defect to any product sold arising from where applicable, neglect, wear and tear, wilful damage, abnormal or adverse working conditions, failure to follow supplied instructions, misuse, and/or alteration occur or repair of the goods without written prior consent from Mad Jam Music. MJM will be under no liability for the goods if not paid for in full by the due date. Mad Jam Music is not liable for goods lost in transit when sent by customer to MJM premises for any reason. MJM will only accept liability for goods received and signed for when sent with prior written consent from MJM along with accompanying documentation. MJM will be under no liability for goods returned without prior consent and/or relevant documentation. MJM will not be liable for any expense for re-dispatch of goods to customers incorrectly returning goods to MJM for any purpose.
Delivery
Delivery prices are for mainland UK excluding the Channel Isles and Scottish Higlands. For delivery prices to these regions please email enquiries@madjam.co.uk and we will contact you with the carriage costs for you area.
Returns
Goods correctly supplied to customers will not be accepted for return without the written prior agreement of Mad Jam Music and an accompanying returns note. MJM shall be under no liability for returned goods lost in transit when sent by customer to MJM premises for any reason. Goods returned by customers which, are found to be defective will be returned at the expense of the customer and must be returned within 30 days of receipt of goods with the written prior agreement of Mad Jam Music and an accompanying returns note. Refunds for returned goods will only be issued by MJM once the goods have been received, checked and found to be defective or faulty where the cause of the fault or defective part is due to manufacturing. If the return of goods is not because of a fault by MJM or the manufacturer (customer fault) then the customer will be liable for carriage between the customer address and MJM premises and any costs incurred by MJM for the processing of any such item(s). The said goods will only be dispatched once payment has been received in full from the customer. Mad Jam Music is unable to accept returns for Headphones once used unless faulty, (30 day rule applies), In ear equipment, Cartridge or Styli, Microphone heads, popper stoppers goods modified to order e.g, speaker cable cut to size.
Warranty
MJM warrants to the customer that the goods supplied will be free from defect as supplied by the manufacturer and/or distributor in workmanship and materials for a period of twelve (12) months from the date of goods dispatch to the customer. This warranty will not apply in the event of misuse or abuse of the goods or as a result of unauthorised repair, alteration or repairs carried out without the expressed prior written permission of MJM. The warranty will also become void if any original serial number is altered, defaced, obscured, removed or damaged in any way. Before any goods for repair under warranty are returned there must be prior written consent from MJM and goods must be sent carriage paid accompanied by a copy of the original bill of sale from MJM and a returns note bearing a full description of the fault.
Force Majure
MJM will not be liable for any delay in or failure to carry out any of its obligations if the delay or failure is caused by circumstances outside the reasonable control of Mad Jam Music. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond the reasonable control of Mad Jam Music:- Act of God, explosion, flood, strikes and lock outs, prohibitions, acts of governments, acts of terrorism, fuel and/or power deprivation or failure.
In the interests of the company Mad Jam Music reserves the exclusive rights to amend and/or revise where necessary the conditions of sale.
